THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9906 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.3 seeking bail in the event of his arrest in connection with Crime.No.1334 of 2021 on the file of Gachibowli Police Station, Cyberabad Commissionerate, registered for the offences under Sections 419, 420 and 395 r/w. 34 of IPC.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The Gachibowli Police filed charge sheet against this petitioner and eight others for offence of cheating and committing dacoity. According to the investigation, this petitioner was part of the group which committed dacoity. Investigation is complete and charge sheet is already filed. Non-bailable warrants were issued against this petitioner.

Learned counsel appearing for the petitioner would submit that case in the trial Court is on 13.10.2023.

In view of the completion of investigation, this Court deems it appropriate to direct the petitioner to appear on 13.10.2023 before the concerned Court and file an application under Section 70 (2) Cr.P.C. Upon filing such application, the Court below shall recall the warrants on condition of petitioner executing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to his satisfaction. 6.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
