CVNR, J CRP 4768/2017 ORDER:

This civil revision petition is filed against order dt.18.4.2017 in I.A. No.1517 of 2016 in O.P. No.1324 of 2014 on the file of the Judge, Family Court-cum- V Additional District and Sessions Judge, Visakhapatnam.

In spite of receipt of notice, the respondent has not entered appearance.

The petitioner has filed O.P. No.1324 of 2014 for dissolution of the marriage with the respondent. The respondent has filed I.A. No.1517 of 2016 in the said O.P. under Section 24 of the Hindu Marriage Act, 1955, for interim maintenance at the rate of Rs.10,000/- per month. She has pleaded that the petitioner is earning Rs.40,000/- as a private employee in Autonagar, in Gajuwaka. The petitioner has pleaded that he is a daily labourer and earning Rs.200/- per day. In the absence of satisfactory evidence adduced by both the parties, the Court below has awarded the maintenance of Rs.3,000/- per month.

Considering the inflationary trend in the society, by no means the sum of Rs.3,000/- ordered by the Court below can be said to be very unreasonable. However, considering the plea of the petitioner that he is not earning the income as alleged by

CVNR, J CRP 4768/2017 the respondent and her failure to contest this revision petition, I am of the opinion that it would be reasonable to fix the monthly maintenance at Rs.2,500/- instead of at Rs.3,000/-. The order under revision is accordingly modified to this extent. The civil revision petition is accordingly partly allowed. As a sequel to disposal of the civil revision petition, C.R.P.M.P. No.6218 of 2017 shall stand disposed of as infructuous.
