THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION NO.4867 OF 2018 ORDER:

This civil revision petition is filed under Article 227 of the Constitution of India, questioning the in-action of the I Additional District & Sessions Judge, Kadapa, for non-disposal of O.S.No.30 of 2017, since the rights of the parties are almost decided in the earlier round of litigation.

Learned counsel for the petitioner made similar request at the time of hearing this matter.

Since the suit is the year 2017, the I Additional District & Sessions Judge, Kadapa cannot give undue preference to this suit alone, more particularly, when there are certain directions from Supreme Court and this Court to dispose of pre-2012 cases. Therefore, keeping in view the directions issued by the Supreme Court and this Court regarding disposal of pre-2012 cases, the I Additional District & Sessions Judge, Kadapa is requested to dispose of O.S.No.30 of 2017, as expeditiously as possible, without giving any undue preference to this suit.

With the above direction, civil revision petition is disposed of at the stage of admission.

Consequently, miscellaneous petitions pending, if any, shall also stand closed. No costs.
