HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.37561 of 2015 ORDER : (Per Hon'ble Sri Justice R.Subhash Reddy) When the matter is called for hearing, learned counsel appearing for the 1st respondent Bank produced two letters, one of which is addressed by the borrower-M/s. Karthik Steel Industries, the 3rd respondent herein, and another is addressed by the lessee-M/s. Deepak Industries, the petitioner herein. In the letter, dated 08.01.2016 addressed by the petitioner, it is stated that the petitioner would like to vacate the premises and sought permission to remove the machinery and also agreed to withdraw the cases.

In view of the request made by the petitioner in their letter dated 08.01.2016, learned Standing Counsel for the 1st respondent Bank expressed no objection for the petitioner's removing the machinery as per their letter dated 08.01.2016, more particularly in view of the letter addressed by the borrower on 16.01.2016. In that view of the matter, this Court is of the view that no adjudication is necessary in this writ petition.

Accordingly, the Writ Petition is dismissed. No order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
