THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25040 of 2017 ORDER:
The petitioner states that she is running a mineral water unit in door No.D-81, Mahadevpuram, Gajularamaram, Medchal District, Hyderabad, under category LT II (B)-Non Domestic/Commercial-Above 50 Units/Month vide service connection No.090903965. While so, the unit was inspected by the inspection squad on 18.05.2017 and it was noticed that the meter was not functioning properly. In that connection, back billing amount was assessed at Rs.4,23,970/- for the period from 22.03.2013 to 18.05.2017 and the petitioner was directed to pay 50% of the said amount. The petitioner states that along with the notice the service connection was disconnected. In those circumstances, challenging the letter dated 14.06.2017 the present Writ Petition is filed.
Learned Counsel for the petitioner submits that demanding the amount from 2013 is bad in law and contrary to the regulations framed by the respondents.
Learned Counsel for the respondents submits that now a mechanism is available to detect the date from which there was a defect in the meter and in view of the same, it can be easily verified with regard to the date of occurrence of defect. Be that as it may, in view of the provision of making a representation to the Divisional Engineer/Operation, Medchal,
as indicated in the letter dated 14.06.2017, the service connection of the petitioner shall be restored on payment of 1/4th (one fourth) of Rs.4,23,970/- by the petitioner, and it is open to the petitioner to submit a representation to the Divisional Engineer/Operation, Medchal, on receipt of which the Divisional Engineer/Operation, Medchal, shall consider the same and pass appropriate orders in accordance with law. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
