This appeal is filed under Section 104 read with Order XLIII Rule 1 of C.P.C. assailing the order dated 06.10.2005 passed in C.F.R.No.7051 of 2005 (unnumbered plaint) on the file of the Principal District Judge, Kurnool.

Learned counsel for the appellant seeks permission of this Court to permit the appellant to withdraw the appeal with a liberty to avail the remedies available to him under law. Permission is granted.

Accordingly, the Civil Miscellaneous Appeal is dismissed as withdrawn granting liberty as prayed for. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Appeal shall stand closed.
