This writ petition is filed challenging the action of the respondents in not registering a crime having received the complaint on 17-03-2018, which is a cognizable offence. Learned Assistant Government Pleader for Home produced written instructions stating that on receipt of complaint from the petitioner on 17.03.2018, enquiry was conducted which disclosed that the issue is civil in nature and therefore the complainant was called over phone for referring the matter to the Pre Litigation Counsel Forum, Vijayawada, for redressal; that as the petitioner did not approach for referring his petition to the said forum, he was informed through letter by registered post dated 09.07.2018, that the contents in complaint dated 17.03.2018 are civil in nature, as such, advised to approach the civil court for redressal of his grievance.

The same is disputed by the learned counsel for the petitioner who submits that though the complaint discloses that it is a congnizable offences, inspite of taking action, respondent police are resorting to such action. In view of the aforesaid facts and circumstances, the writ petition is disposed of directing the respondent police to

take action on the complaint of the petitioner, by following the guidelines of the Supreme Court in Lalita Kumari v. Government of Uttar Pradesh (2014) 2 SCC 1. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 19.07.2018 t k.
