THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6310 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue writ or direction preferably writ of mandamus declaring the action of the respondent Nos.1 and 2 in not extending the lease period despite report submitted by the Inspector of Auditor of Wakfs, Khammam in file No.50/Khm/15 dt.29.08.2015 in respect of the land admeasuring Ac.1-03 gts., in Sy.No.496 situated at Khammam town, Khammam District as illegal, arbitrary, and violative of principles of natural justice and consequently direct the respondent Nos.

1 and 2 to finalize the said proceedings for extension of lease in favour of petitioner for further period of 30 years and pass such other or further orders as this Hon'ble Court deems fit and proper in the circumstances of the case." The representation dated 20.08.2015 made by the petitioner seeking extension of the lease is still awaiting consideration by the State Wakf Board. That being so, this Court is not inclined to entertain this writ petition for adjudication on merits. The writ petition is therefore disposed of at the admission stage directing the respondent authorities to consider the petitioner's representation dated 20.08.2015 in accordance with law and take appropriate action in the matter.

In the event the petitioner's request for such renewal is denied, the reasons therefor shall be recorded and duly communicated to the petitioner. This entire exercise shall be completed expeditiously and in any event, not later than six weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________________ SANJAY KUMAR, J Date:26.02.
