THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA M.A.CMA.No.459 OF 2011 JUDGMENT:

Sri Maheswara Rao Kunchem, learned counsel for the appellant - M/s. Shriram General Insurance Company Limited, would represent that respondent Nos.1 to 5 - claimants filed memo, dated 02.09.2016, stating that a compromise has been entered into between both the parties, pursuant to which, respondent Nos.1 to 5 have accepted to waive interest, which proposal was accepted by the appellant - Insurance Company, and the appellant has taken a Demand Draft for an amount of Rs.2,52,220/- towards full and final settlement, lying to the credit of the O.P., and seeks permission to withdraw the appeal as not pressed.

2. Sri T.S. Rayulu, learned counsel representing Smt. Kavitha Gotipati, has submitted a set of papers containing copy of the memo, dated 02.09.2016, copy of the letter addressed to the Brach Manager of the appellant, copy of memo, dated 30.03.2016, filed in M.V.O.P.No.428 of 2009 on the file of Chairman, Motor Accidents Claims Tribunal - cum - I Additional District Judge, Ongole, with cheque and copies of two more cheques, dated 08.04.2011 and 18.02.2011, respectively, which papers were given USR No.6071 of 2016, and states that pursuant to the compromise entered into between the parties, the appeal filed by the Insurance Company may be closed.

3. In view of the submission made by the learned counsel for both sides, the present appeal is dismissed as not pressed. Consequently, respondent Nos.1 to 5 - claimants are permitted to withdraw the amount deposited by the appellant lying to the credit of M.V.O.P.No.428 of 2009 on the file of Chairman, Motor Accidents Claims Tribunal - cum - I Additional District Judge, Ongole.
