HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 22121 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for Shop No.190 of Hasan Nagar, Shivarampally, Rajendranagar Mandal, Ranga Reddy District and his authorization is valid up to 31.3.2017. It appears that the fourth respondent along with Vigilance and Enforcement officials inspected the fair

price shop of the petitioner on 24.1.2015 and noticed some variations in the stock. Based on the report submitted by the fourth respondent, 6-A proceedings were initiated and the same are pending. While so, the third respondent issued a show cause notice on 5.2.2015 and on the same day he tagged on the fair price shop of the petitioner to another dealer of Fair Price Shop No. 227 without suspending and cancelling his authorization. When the essential commodities are not released, the petitioner filed the present Writ Petition. The learned Government Pleader based on the instructions submits that the authorization of the petitioner is valid and in force as of today. If the authorization of the petitioner is in force, the third and fourth respondents should supply the essential commodities to the petitioner for his onward distribution. In the circumstances, the third and fourth respondents are directed to release the essential commodities so long as the authorization of the petitioner is valid and in force.

Subject to the above the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
