HON'BLE SRI JUSTICE S. RAVI KUMAR C.M.A.No.1560 of 2008 JUDGMENT:

This appeal is preferred against order dated 03.12.1991 in I.A.No.1475 of 1991 in O.S.No.139 of 1991 on the file of Subordinate Judge at Karimnagar, dismissing the petition filed by appellant under Order 39 Rule 1 read with 151 CPC.

2. As seen from the record appeal is filed with delay condonation petition in the year 1992, delay was condoned in the year 2008 and thereafter appeal was numbered.

3. As per the office note, the suit in O.S.No.139 of 1991 itself was disposed of and appeal preferred against the suit was also dismissed for default on 27.09.1995.

4. In spite of posting the matter under the caption 'Specially identified cases', neither advocate for appellants is present nor any representation is made on behalf of appellants.

Considering these aspects, this Civil Miscellaneous Appeal is dismissed for non-prosecution. No costs.

Miscellaneous Petitions, pending in this Appeal, if any, shall stand closed.
