HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6137 of 2016 ORDER:

This petition is filed by the petitioner - Accused No.1 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail to him in P.R.C.No.4 of 2016 on the file of the Additional Judicial Magistrate of First Class, Bodhan.

Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Section 395 IPC. It is the case of the prosecution that three unknown persons engaged the vehicle of the de facto complainant, who is a driver of TATA Sumo, on hire to go to Badapahad. From there, they went to Railway Station, Nizamabad and other three unknown persons also boarded in his vehicle along with their luggage and went to Badapahad. While returning from Badapahad, on the way, one of the inmates requested the de facto complainant to stop the vehicle as he was feeling vomiting. When the vehicle was stopped, three persons got down and pushed the de facto complainant by threatening him with a knife and took away his vehicle. Learned Counsel for the petitioner submitted that the petitioner is no way concerned with the offence and he was falsely implicated in the above crime and that the petitioner was arrested on 19.12.2015 and since then, he has been in prison.

Learned Public Prosecutor submitted that there are two previous cases against the petitioner in other states and that one case is in Maharastra and that if the petitioner is released on bail, there is every possibility of jumping the bail.

In view of the above submissions made by the learned Public Prosecutor, this Court is of the view that it is not a fit case to grant bail

to the petitioner.

Accordingly, the Criminal Petition is dismissed. _______________ RAJA ELANGO, J 1st June, 2016.
