HON'BLE SRI JUSTICE S.V. BHATT C.R.P.No.2447 OF_2011 ORDER:

Heard the learned counsel for petitioners and respondents. Defendants 14 and 19 to 23 are revision petitioners. The revision petitioners filed I.A.No.24 of 2011 in O.S.No.335 of 2004 to call for the judgment and decree in O.S.No.37 of 1969 on the file of the Additional Chief Judge, City Civil Court, Hyderabad. The said application was dismissed b the order impugned in the Civil Revision Petition.

Learned counsel for petitioners contends that the petitioners in spite of best efforts could not secure the certified copy of judgment and decree in O.S.No.37 of 1969. Hence, they are compelled to file the instant application. The trial Court ought not to have dismissed the application.

I have perused the record. Prima facie, this Court is of the view that each one of the reasons given by the trial Court is relevant and the complacency with which the case is conducted is also stated.

Having regard to the findings recorded with which this Court is in complete agreement, the revision fails and is accordingly dismissed. No order as to costs.
