THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.32205 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Standing Counsel for respondents.

2. The case of the petitioner is that the third respondent issued a tender notice inviting sealed tenders for lease of college canteen for two years. The late date for receipt of the sealed tender was 09.09.2015 and the petitioner became successful tenderer. He was awarded the lease of the college canteen for a period of two years. The petitioner submitted a representation before the third respondent stating that he could not pay the bid amount within the specified time due to Government holiday on 17.09.2015 and his illness and sought extension of time for payment of the bid amount. The third respondent issued a letter dated 21.09.2015 cancelling the leasehold rights of the petitioner on the ground that the petitioner did not pay the bid amount and did not enter into agreement within the specified time. Challenging the same, the present Writ Petition is filed.

3. The Writ Petition came up for consideration on 01.10.2015 and it was adjourned to today in order to enable the learned Standing Counsel to get instructions, but no instructions have been received.

4. In the circumstances, this Writ Petition is allowed giving liberty to the petitioner to pay the bid amount of Rs.4 lakhs and enter into an agreement with the third respondent on or before 09.10.2015, failing which, it is open to the third respondent to take necessary steps for granting lease to any other party. No order as to costs. Miscellaneous petitions, if any pending, shall stand closed.
