HON'BLE SRI JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT APPEAL No. 1691 OF 2014 JUDGMENT: (per the Hon'ble Sri Justice Dilip B. Bhosale) This writ appeal is directed against the order dated 25-04-2013 disposing of Writ Petition No.9051 of 2012 filed by respondent Nos.1 to 9. The operative portion of the order passed by learned single Judge reads thus:
"In the circumstances, this writ petition is allowed directing the respondents to consider the case of the petitioners on par with the similarly situated persons conferring similar benefits as was done in G.O.Ms.No.144, School Education (PS.I) Department, dated 01.10.2004 and pass appropriate orders in accordance with law." Learned counsel appearing for the appellants submits that after the impugned order, the appellants have considered the case of respondent Nos.1 to 9 and passed order on 07-10-2014. By this order, she submits that they have rejected the claim of respondent Nos.1 to 9 on the ground that the respondent - School was/is not admitted to grant-in-aid. In this view of the matter, she submits that nothing further survives in the writ appeal.
Hence, the writ appeal is disposed of as rendered infructuous. It is open to respondent Nos.1 to 9 to challenge the order dated 07-102014 passed in pursuance of the order passed by learned single Judge dated 25-04-2013 in Writ Petition No.9051 of 2012 in appropriate proceedings. If any such proceedings is instituted by respondent Nos.1 to 9, same shall be considered on merits in accordance with law.
Miscellaneous petitions, if any, also stand disposed of. There shall be no order as to costs.
