HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.4999 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for transport appearing for the respondents. Petitioner states that he is owner-cum-driver of a tractor bearing No. AP 01 V 0394 and trolley 0395. Alleging that the said vehicle was seized on 16.02.2015 by the first respondent on the ground that it was not accompanied by any proof of valid documents and the seized vehicle is kept in A.P.S.R.T.C., Bhainsa. Petitioner seeks for release of the said vehicle and he is stated to have been approached the first respondent by an application dated 18.02.2015 and has filed the writ petition alleging inaction and also questions the seizure report. Petitioner contends that he is having all the valid documents, but however, an enquiry into that aspect is required to be conducted by the first respondent.

So far as request for release of the vehicle is concerned, petitioner has to make an appropriate request before the second respondent, who is the competent authority. Hence, the writ petition is disposed of permitting the petitioner to make an appropriate application before the second respondent seeking release of the said seized vehicle and petitioner is also at liberty to submit proof of valid documents before the second respondent as well as the first respondent. If any such application is received from the petitioner, the second respondent shall consider the same and pass appropriate orders, preferably, within three days from the date of receipt of copy of this order.
