THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.27513 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the fourth respondent in disposing of O.A.No.24 of 2015, as illegal, arbitrary and against the principles of natural justice.
2. Heard the learned counsel for the petitioner, the learned Government Pleader for respondent Nos.1 and 2, and Smt. K.Lalitha, the learned Standing Counsel for respondent No.3.
3. A perusal of the record reveals that the petitioner filed O.A.No.24 of 2015 on the file of the Endowments Tribunal at Hyderabad.
4. The learned Standing Counsel for the third respondent submitted that recently Endowments Tribunal was constituted for the State of Andhra Pradesh. She further submitted that number of cases are pending on the file of the Endowments Tribunal at Guntur.
5. At the time of argument, the learned counsel for the petitioner submitted that the fourth respondent may be directed to dispose of O.A.No.24 of 2015 as expeditiously as possible.
6. Having regard to the facts and circumstances of the case and the submissions made by learned counsel for both parties, and also keeping in mind the pendency of the matters on the file of the Endowments Tribunal at Guntur, the fourth respondent is hereby directed to dispose of O.A.No.24 of 2015, as expeditiously as possible, preferably within a period of eight (8) months from the date of receipt of a copy of this order.
7. With the above direction, the Writ Petition is disposed of. No costs.
8. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
