This civil miscellaneous appeal is filed under Order XLIII Rule 1 of CPC challenging the order dated 06.9.2016 in I.A. No.795 of 2015 in O.S. No.243 of 2015 on the file of the Court of VII Additional District Judge, Ongole.

At the time of hearing, learned counsel for the appellant seeks permission of this court to permit the appellant to withdraw the civil miscellaneous appeal with liberty to file fresh application before the trial court. Permission is granted. 3.
