THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR CIVIL REVISION PETITION No.3233 of 2015 ORDER :

The order of the Court below dated 06.08.2015 is questioned by the petitioner/plaintiff in this Civil Revision Petition. The Court below has granted an order of status quo in the Injunction petition i.e., I.A.No.252 of 2015 in O.S.No.188 of 2015 on 16.04.2015 and thereafter though the said I.A., is coming up for hearing and the respondent is pressing for hearing, the petitioner is not reporting ready to argue the I.A. Hence, the Court below passed the order on 06.08.2015 recalling the earlier order of status quo and posted the I.A., for hearing on 17.08.2015.

Learned counsel for the petitioner states that the matter is further being adjourned from 17.08.2015.

Looking at the docket order of the Court below, it is noticed that the Court had taken note of the delay on the part of the petitioner and hence, recalled the status quo order. However, the I.A., is required to be heard and disposed of expeditiously as the respondent is reporting ready but the petitioner is taking time.

In the circumstances, I am not inclined to interfere with the impugned order. However, I direct the learned Additional Senior Civil Judge, Chittoor, to take up the I.A.No.252 of 2015 in O.S.No.188 of 2015 on the next date on which, it is scheduled to be heard and after hearing both sides dispose of the same on merits.

With the above, direction, this Civil Revision Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Civil Revision petition shall stand dismissed.
