THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 7278 OF 2018 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'Cr.P.C.') to quash the order dated 08-05-2018 in Criminal M.P.No. 1882 of 2018 in P.R.C.No. 20 of 2018 on the file of the Court of VI Additional Chief Metropolitan Magistrate at Hyderabad (for short, 'the Court below'), whereby the Court below dismissed the above miscellaneous petition filed by the petitioner to recall the N.B.W. issued against him. 2.

At the hearing, learned counsel for the petitioner, without going into the merits of the case, has requested this Court to permit the petitioner to appear before the Court below and file a petition under Section 70 (2) of Cr.P.C. to recall the N.B.W. pending against him.

In view of the request made by learned counsel for the petitioner, without touching the merits of the case, it is suffice to permit the petitioner to appear before the Court below and file appropriate application after serving notice on the respondent and on filing such application, the Court below is directed to dispose of the same on the same day in accordance with law. 4.

With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions, if any, in this criminal petition shall stand closed in consequence.
