HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.36806 of 2013 ORDER:

The petitioner is claiming as owner of the land of an extent of Ac.2-05 cents in toto of Pedanadipalli Revenue Village, Cheepurupalli Mandal, Vizianagaram District. It is his claim that the lands situated in survey Nos.14/6 (Ac.0-28 cents), 14/19 (Ac.0-51 cents), 14/20 (Ac.0-38 cents) and in S.No.13 (Ac.0-88 cents), which comprise the total extent supra. It is his representation to respondent Nos.1 to 4 herein i.e., MRO, Cheepurupalli, Mandal Surveyor, Cheepurupalli, Revenue Divisional Officer, Vizianagaram and the District Collector, Vizianagaram District respectively that M/s. Global Associates of Keonjhar District, Orissa State claim to have been obtained lease for excavation of manganese ore for a period of 20 years in survey Nos.31/7&8, 32/6&7, 39/9&11 and 40/1&2 of 8.

190 hectares of land of Pedanadipalli Revenue Village, Cheepurupalli Mandal, Vizianagaram District. Under the guise of excavation of manganese ore for their lease hold mining land, they are encroaching into the petitioner's land and uprooting physical features of the boundaries by using proclainers and removing the stones, which can be resisted and thereby to conduct survey of fixing the boundaries so that they cannot lay any road by encroachment into the petitioner's land for their to and fro to the said lease hold mining land.

It is the submission of the learned Assistant Government Pleader for revenue for respondent Nos.1 to 4 that but for making several representations even to consider for fixation of the boundaries, there is no amount paid by way of challan as contemplated and if he complies with the same, Mandal Surveyor will be directed to conduct a survey and fix the boundary line.

Having regard to the above, this writ petition is disposed of directing the petitioner to approach the Mandal Revenue Officer, Cheepurupalli with the order copy and in such event, the MRO shall

guide him to pay challan head on account for fixation of boundaries and direct the Mandal Surveyor to cause a survey of the land of the petitioner by fixing 4 of the boundaries of the said extents within two

(02) months from the date of receipt of a copy of this order. Accordingly, this writ petition stands disposed of. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
