THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.12722 OF 2017 ORDER:
This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue an Order, Direction or Writ more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondents more particularly the 4th Respondent herein in dispossessing petitioner from her owned and possessed agricultural land bearing Survey Nos. 145/41, 145/44 & 145/46, total admeasuring Ac.
1100 Guntas, situated at Suddapalli, Dichupalli Mandal, Nizamabad District, together with Ankush Goshalas, Mango Garden, in the process of establishment of proposed Yanampally 400 KV to Dichupally 200 KV Line, without following the due process of law, as illegal, arbitrary, high handed, unjust, unreasonable, without any sanction of law and/or jurisdiction, and violative of Principles of Natural Justice, Fair Play and Equity, besides, being infringement of Fundamental and Constitutional Rights guaranteed under Article 14, 19, 21 & 300-A of the Constitution of India and consequently direct the Respondents to desist permanently from adopting any unlawful and illegal acts in and over the subject property owned and possessed by the petitioner."

Heard the learned counsel for the petitioner and Sri R.Vinod Reddy, learned Standing Counsel for the respondent Corporation.

According to the learned counsel for the petitioner, without following the due process of law, the respondents herein are trying to dispossess the petitioner herein from the subject property in the name of establishment of proposed Yanampally 400 KV to Dichupally 200 KV Line.

When the matter is taken up, on instructions, it is submitted by learned Standing Counsel that the respondents herein would strictly adhere to law and they pay compensation to the petitioner herein in accordance with law. He also submits that if the petitioner herein makes necessary application for payment of compensation to the respondents herein, the same will be considered by the respondents herein for taking appropriate action.

The above submissions are placed on record and the Writ Petition is disposed of, directing the respondents herein to adhere to due process of law for establishment of proposed Yanampally 400 KV to Dichupally 200 KV Line and it is kept open for the petitioner herein to make a representation to the respondents herein for payment of compensation. If any such representation is made by the petitioner, the same shall be considered and appropriate action be taken, in accordance with law, for payment of compensation.
