THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9565 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.1130 of 2023 on the file of L.B.Nagar Police Station, Rachakonda Commissionarate, registered for the offences under Sections 376 (2) (n), 344, 366, 493 and 506 of IPC and Section 5(1) r/w. 6 of POCSO Act, 2012. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner was arrested on the ground of raping a victim girl who is aged more than 17 years. It is the case of the prosecution that parents of the victim girl lodged a complaint on 04.08.2023 stating that victim girl was missing after she left to college on 03.08.2023. The Police having taken up investigation, the victim returned to the house on 17.08.2023. On examination, it is revealed that

the petitioner had proposed to her earlier and there was also exchange of phone numbers. Since the affair of the victim girl and the petitioner was known in the house, they have reprimanded the petitioner and the victim. It is further stated by the victim girl that she went to Vijayawada in the bus and she was forced to stay in a room. On 06.08.2023, the petitione took her to one of the temples and married her by tying 'thaali' (sacred thread). 4.

As seen from the record, witnesses were examined and in facts of the present case that the victim girl went missing on 04.08.2023 and came back after 13 days. In view of the major part of the investigation is complete, this Court deems it appropriate to grant the relief of regular bail, subject to following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties, for a like sum each to the satisfaction of II Additional Metropolitan Magistrate, L.B.Nagar, R.R.District. ii) The petitioner/Accused after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of one week for the

purpose of investigation and thereafter, as and when required.

iii) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
