THE HON'BLE SRI JUSTICE S.V.BHATT W.P.No.28388 of 2016 ORDER:

The petitioner prays for the following relief:- "... to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the 2nd respondent herein in seizing the Maxi Cab bearing registration No.AP 28 TC 0477 vide Vehicle Check Report No.2609261, dated 09-07-2015 as illegal, arbitrary and unconstitutional and consequently direct the respondents herein to release the vehicle Maxi Cab bearing registration No.AP 28 TC 0477 to the petitioner herein....." Counsel for petitioner, having regard to the date of seizure of vehicle bearing No.AP 28 TC 0477, modifies the prayer to permit the petitioner to file appeal before the RTA, Sanga Reddy, and the appellate authority may be directed to consider and pass orders on the grievance of petitioner.

Without expressing any view on the merits, the writ petition is disposed of by giving liberty to petitioner to avail the remedy of appeal, by enclosing a copy of this order, and the appellate authority is directed to pass orders within two weeks from the date of presentation of appeal. No order as to costs.
