THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26080 of 2017 ORDER :
This writ petition is filed assailing the proceedings dated 22-07-2017 passed by the 2nd respondent terminating the services of the petitioner as Angawadi Assistant.

Learned counsel for the petitioner submits that though show cause notice was issued and the petitioner filed her explanation on 11-07-2017, the 2nd respondent passed the impugned order without considering explanation in the proper perspective, as no reasons are stated in terminating the services of the petitioner, and the same is in sheer violation of principles of natural justice. On the other hand, learned Asst. Government Pleader for Women Development and Child Welfare stated that after following the due procedure, the impugned order is passed.

On a perusal of the impugned order, it is seen that no reasons are stated in the impugned order except referring to the explanation filed by the petitioner and such explanation not found to be satisfactory. The said course adopted by the 2nd respondent in not assigning reasons in terminating the services of the petitioner is in violation of principles of natural justice and on this short ground alone the impugned order is set aside. However, this order will not preclude the respondent-authorities from passing a speaking order
after considering the explanation of the petitioner filed earlier in the matter.

The writ petition is allowed to the extent indicated above. Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
