THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9554 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.3 to 5 in Crime.No.150 of 2023 on the file of Kesamudram Police Station, Mahbubabad, registered for the offences under Sections 148 and 307 r/w. 149 of IPC. 2.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioners were arrested on 21.08.2023. The allegation is that these petitioners along with other accused chased the victim and tried to kill him.

Since several witnesses were examined and the petitioners are in jail since 21.08.2023, the prayer for regular bail can be considered subject to following conditions:-

i) The petitioners/Accused Nos.3 to 5 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of Additional Judicial Magistrate of First Class, Mahbubabad.

ii) The petitioners/Accused Nos.3 to 5 after release shall appear before the concerned Station House Officer on every Monday for a period of eight weeks at 10.00 AM and thereafter as and when required, for the purpose of investigation.

iii) The petitioners/Accused Nos.3 to 5 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
