THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.32223 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the 2nd respondent in not considering the petitioner's representation dated 16-09-2015 for compounding the Criminal case in COR No.450/2015-16, dated 01-07-2015, on the file of Proh. & Excise Inspector, Rajendernagar, Rangareddy District, and the Departmental proceedings initiated by the licencing authority, under clause - b of Sub- Section-I of Section 31 of the A.P. Excise Act, 1968, as illegal, arbitrary and violation of principles of natural justice consequently direct the 2nd respondent to compound the Criminal case in COR No.450/2015-16, dated 01-072015, on the file of Proh. & Excise Inspector, Rajendernagar, Rangareddy District, and the Departmental proceedings initiated by licencing authority, under clause - b of Sub- Section-I of Section 31 of the A.P. Excise Act, 1968, in respect of the Toddy Co-operative Society, Upparpally Village, Rajender Nagar Mandal, Rangareddy District."

Heard Sri Bollepalli Sai Ram Goud, learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise for respondents, apart from perusing the material available before this Court. During the course of hearing it is submitted by the learned counsel for the petitioner that for redressal of the grievance of the petitioner herein the petitioner herein submitted a representation, dated 16-09-2015 to the 2nd respondent herein and appropriate directions may be issued to the 2nd respondent to take action on the said representation, in accordance with law, by fixing some timeframe. The said request is not opposed and this Court considers the said request as reasonable.

In view of the above, the writ petition stands disposed of, without expressing any opinion on the merits of the matter, directing the 2nd respondent herein to

pass appropriate orders on the representation, dated 16-09-2015 said to have been submitted by the petitioner herein, strictly in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
