JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This family court appeal arises out of order and decree, dated 01.06.2011, in FCOP.No.376 of 2008, on the file of the learned Judge, Family Court at Hyderabad whereby he has granted decree for dissolution of marriage between the appellant and the respondent. Both the parties have filed FCA.MP.No.165 of 2016 for passing a decree in terms of memorandum of compromise, dated 04.04.2016. Sri M.V.S.Suresh Kumar, learned counsel for the appellant, submitted that in terms of Clause 6(ii) of the memorandum of compromise, the respondent has handed over demand drafts for a total sum of Rs.22,00,000/- to his client who is present in the Court and that the appeal may be disposed of in terms of the said memorandum of compromise.
The appellant and the respondent who are personally present in the Court have informed us that they have entered into the memorandum of compromise out of their free will and consent and that they have decided to judicially separate and live as per the memorandum of compromise. In the light of the above facts, the order under appeal is modified in terms of memorandum of compromise and FCA.MP.No.165 of 2016 and FCA are disposed of with the direction that the terms of memorandum of compromise shall be incorporated in the decree to be passed in the appeal. As a sequel to disposal of the FCA, FCA.MP.Nos.387 and 388 of 2011 shall stand disposed of as infructuous.
