O R D E R

Petitioner's mother was allegedly employed as nurse under the 3rd respondent. She died on 13.12.2013. Petitioner claims to be her only daughter. Petitioner alleges that the 5th respondent is not the husband of her deceased mother, but he has managed to obtain a legal heir certificate and that the respondents should be restrained from taking any action on the basis of the said certificate.

Whether the 5th respondent is lawful husband of the mother of the petitioner or not, is purely a civil dispute, which cannot conveniently be adjudicated under Article 226 of the Constitution of India. Therefore, granting liberty to the petitioner to approach a competent civil court / family court / appropriate forum, the writ petition is dismissed at the stage of admission.

No order as to costs.
