Heard both sides.

The present writ petition came to be filed questioning the inaction on the part of respondent police in conducting investigation in Crime No.60 of 2011 of Kothur Police Station, Mahbubnagar District, registered for an offence punishable under Section 420 of IPC. 3.

At the time when the matter is taken up for hearing, learned Government Pleader, placed on record written instructions received from the concerned Station House Officer, wherein it has been stated that the Sub Divisional Police Officer, Shadnagar, accorded permission to refer the case as 'false' vide C.No.438/ FR/ SD-SNR/ 2011, dated 30.07.2011. It is also stated that after serving the notice on the informant, a final report was filed before the Court on 30.07.2011. A copy of the report is also placed on record.

That being the position, question of directing the respondent police to conduct investigation, as sought for, does not arise and hence the writ petition is liable to be dismissed.

Accordingly, the writ petition is dismissed giving liberty to the petitioner to avail the remedies available under law. No costs. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
