THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL REVISION CASE NO.373 OF 2006 ORDER:

This revision is filed by the petitioner-complainant under Sections 397 and 401 Cr.P.C. challenging the judgment, dated 28.04.2005 in Crl.A.No.156 of 2004 on the file of the IV Addl. District and Sessions Judge (Fast Track Court), Siddipet, wherein the accused was acquitted for the offence punishable under Section 498-A IPC.

When the matter had come up earlier on 02.04.2018, none appeared and there was no representation on behalf of the petitioner. Therefore, the matter was directed to be listed today under the caption for 'dismissal'. Even today also, none appeared and there is no representation on behalf of the petitioner.

Heard the learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record. 4.

P.W.1 is the victim and P.W.2 is the father of the victim. As per the evidence on record, there were several mediations between the husband and wife with regard to their matrimonial dispute. P.W.3, who is one of the elders to the panchayat, did not state about the alleged demand of additional dowry. Though, P.W.2, father of the victim stated about the alleged dowry harassment, P.W.5, another mediator did not support the version of P.W.2. There are inconsistencies in the evidence of P.Ws. 1 and 2. There are mediation agreement between the parties marked as Exs.P6 and P9. Those documents do not reveal the demand of additional dowry. The 1st appellate Court pointed out so many inconsistencies in the prosecution evidence and did not act upon the evidence of P.Ws.1 and 2. There is no mis-carriage of justice. There is no infirmity in the impugned judgment. There

is nothing to take a different view than the one taken by the 1st appellate Court.

Accordingly, the Criminal Revision Case is dismissed confirming the judgment, dated 28.04.2005 in Crl.A.No.156 of 2004 on the file of the IV Addl. District and Sessions Judge (Fast Track Court), Siddipet.
