HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.1532 of 2016 ORDER:

The present application is filed under Sections 437 and 439 Cr.P.C. seeking bail in S.C.No.5 of 2015 on the file of the Special Judge for Protection of Children from Sexual Offences Act-cumAdditional Metropolitan Sessions Judge, Vijayawada. A charge sheet came to be filed against the petitioner/accused for the offences punishable under Sections 376 (2) (n), 384 and 506 IPC and Section 6 of the Protection of Children from Sexual Offences Act, 2012. The case of the prosecution as stated in the charge sheet is as under:

During the year 2011 while the informant was studying intermediate at NRI College, Chuttugunta, Vijayawada, the petitioner/accused induced her by deceitful words that he is in love with her and took photographs without her knowledge. By putting her in fear of circulation of her photos through internet, the accused forcibly had sexual intercourse with her and also extorted two gold rings, two pairs of ear rings and cash of Rs.20,000/- from her. Basing on these allegations the above crime came to be registered. Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent-State. It is brought to the notice of the Court by the learned Public Prosecutor that the entire trial in the said case is complete and the case is posted for arguments. But the same is disputed by the learned counsel for the petitioner stating that the case is only coming for examination of the Investigating Officer and there is no progress

since then.

The allegations made in the charge sheet being grave and as the trial in the said case is almost complete, I am not inclined to grant bail to the petitioner. Hence, the request of the petitioner is rejected. However, the trial Court shall dispose of S.C.No.5 of 2015 as early as possible, preferably within a period of two (02) months from the date of receipt of a copy of the order.
