CVNR, J & GSP, J CMA.No.261 of 2010 Dt:01.9.2016 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Civil Miscellaneous Appeal is filed against order and decree, dated 22.03.2010, in O.P.No.110 of 2009 on the file of the learned III Additional Senior Civil Judge, Kakinada, whereby he has dismissed the said O.P. filed by the appellant for restitution of conjugal rights.

Mr. V.S.R.Anjaneyulu, learned counsel for the appellant, addressed letter to the Registrar (Judicial), wherein it is mentioned that in CMA.No.957 of 2012, filed against the decree granting divorce, a compromise decree dated 30.01.2015, was passed and that, in view of the same, the appellant seeks to withdraw the present Civil Miscellaneous Appeal. At the hearing, Mr.

Y.Nagaiah, learned counsel representing Mr. V.S.R.Anjaneyulu, learned counsel for the appellant, reiterated the contents of the said letter. In view of the above facts, the Civil Miscellaneous Appeal is dismissed as withdrawn.

As a sequel to dismissal of the Civil Miscellaneous Appeal, CMAMP.No.2582 of 2010 filed by the appellant is dismissed as infructuous.
