Heard the counsel for petitioner, and the learned Government Pleader for Revenue, for respondents.

The petitioner has filed this Writ Petition challenging the inaction of respondent nos.4 and 5 in conducting a survey and effecting sub-division of his land in Survey No.293 of Pasarlapadu Village, Rentachintala Mandal, Guntur District. He also questioned an endorsement dt.08.01.2014 issued by respondent nos.4 and 5, giving two reasons for refusing to survey, i.e., : (a) that the land is not sub-divided in Government Records; & (b) that the neighbour of petitioner did not co-operate.

As regards the first reason, petitioner is seeking sub-division for the first time now. Therefore, the fact that there is no earlier subdivision is irrelevant. 4.
As regards the second reason, that the neighbour of petitioner did not co-operate is concerned, for demarcating petitioner's land and sub-dividing his land in the Revenue Records, the co-operation of the neighbour is unnecessary.

Therefore, it is clear that the impugned endorsement dt.08.01.2014 is perverse and unreasonable, and it is accordingly set

aside. The respondent nos.4 and 5 are directed to forthwith conduct survey and effect sub-division of petitioner's land after demarcating boundaries within eight (08) weeks from the date of receipt of a copy of the order.

Accordingly, the Writ Petition is disposed of directing respondent nos.4 and 5 to forthwith conduct survey and effect subdivision of petitioner's land after demarcating boundaries within eight
(08) weeks from the date of receipt of a copy of the order. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
