THE HON'BLE SRI JUSTICE DILIP B.BHOSALE AND THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT APPEAL No.211 of 2015 P.C: (per the Hon'ble Sri Justice A.Ramalingeswara Rao) This writ appeal is directed against the order, dated 15.07.2014, passed by the learned Single Judge in W.P.No.19635 of 2014.

The respondent was appointed as Casual Conductor in the appellant-Corporation in 2008 and her services were regularized on 01.09.2010. While she was performing duty on 22.01.2013 in the bus bearing No.AP 11 Z 4966, a surprise check was conducted at stage No.16 and it was found that she failed to collect fare from two passengers, who boarded the bus at stage No.15 and bound to stage No.16. The Inspecting Officer, who checked the bus, imposed fine on the passengers, who were travelling in the bus without tickets. A charge sheet was issued to the respondent, who submitted her explanation. Thereafter, a show cause notice was issued and the punishment of deferment of two annual increments for a period of 18 months was imposed by order, dated 23.02.2013. The respondent preferred an appeal against the said order to appellant No.3, who reduced the punishment from 18 months to one year by order, dated 07.11.2013. The review petition filed by the respondent was rejected on 28.03.2014. In those circumstances, the respondent preferred the above writ petition.

The learned Single Judge, noting that it is not a case where the respondent has collected the amount and failed to issue tickets,

modified the punishment by reducing it to withhold the increment for a period of one year without cumulative effect. We have carefully gone through the record and in the facts and circumstances of the case, we do not see any ground to interfere with the order passed by the learned Single Judge. The writ appeal is accordingly dismissed.

Consequently, miscellaneous petitions, if any, also stand disposed of.
