THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.460 OF 2015 ORDER:

This Criminal Revision Case is filed by the petitioner - A4, under Sections 397 and 401 Cr.P.C., challenging the order, dated 11.02.2015 passed in Crl.M.P. No.820 of 2014 in CC No.14 of 2011 by the Principal Special Judge for CBI Cases. Visakhapatnam. The case in brief is that the petitioner is A-4 in CC No.14 of 2014. The charges against the petitioner are that he along with other accused conspired together and caused wrongful loss to the Small Industries Development Bank of India (SDBI), Visakhapatnam, to a tune of Rs.270 lakhs and thereby, committed offences punishable under Sections 120-B read with 420, 467, 468 & 471 IPC and Section 13 (2) read with 13 (1) (d) of the Prevention of Corruption Act. The petitioner filed Crl.M.P. No.820 of 2014 before the Principal Special Judge for CBI cases, Visakhapatnam to discharge him from the said offences. The Court below dismissed the said application through the impugned order. Aggrieved over the same, the present revision is filed.

Heard and perused the material available on record. A reading of the order passed by the Court below discloses that the petitioner and other accused in connivance with the officials of SIDBI got sanctioned a term loan of Rs.270 lakhs for setting up a new project and got disbursed an amount of Rs.175 lakhs among themselves by submitting forged and fake documents to the Bank. The trial Court, after considering the contentions raised by both parties, passed the impugned order. Therefore, this Court is not inclined to interfere with the order passed by the trial Court.

The Criminal Revision Case is, accordingly, dismissed. Miscellaneous petitions, pending if any, shall stand closed. ______________ RAJA ELANGO, J June 23, 2015.
