THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.1052 OF 2017 ORDER:
Heard learned counsel for the petitioner, learned Government Pleader and the learned counsel appearing for the third respondent. This writ petition is filed challenging the registration of F.I.R.No.345 of 2016, dated 19.11.2016, on the complaint lodged by the third respondent. The third respondent lodged the complaint on 28.07.2016, but no crime was registered. The third respondent filed writ petition No.37262 of 2016 and this Court disposed of the said writ petition with a direction to the police to take necessary action pursuant to the complaint lodged by the third respondent. In view of the said order, the above complaint was registered. A perusal of the complaint shows that the allegations relate to the registration of land by the petitioner, where he has no title. This Court, by order, dated 06.01.
2017, directed the second respondent to proceed with the investigation without arresting the petitioner. A counter affidavit is filed by the second respondent stating that the investigation is under progress and necessary steps will be taken for completing the investigation as expeditiously as possible.
In view of the advanced stage of investigation and keeping in view the allegations relate to the execution of sale deed, where there was no title to the petitioner, this Court is inclined to direct the second respondent to continue the investigation without arresting the petitioner as ordered by this Court on 06.01.2017 and file charge sheet/final report not later than three months from the date of receipt of copy of this order.
The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 28.03.2017 pln
