THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9755 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.1 under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in Crime No.18 of 2016 on the file of Ananthagiri Police Station, Visakhapatnam District, registered for the offences punishable under Section 20(b) of the NDPS Act.

Heard and perused the material available on record. It is alleged that the petitioner was found in transporting 120 kgs of ganja.

Learned Counsel for the petitioner submitted that the petitioner did not commit any offence and that the petitioner is the driver of the vehicle and he has nothing to do with the commission of the offence and that the petitioner was arrested on 17.2.2016 and since then, he has been in prison.

Learned Additional Public Prosecutor opposed this petition on the ground that the ganja seized from the possession of the petitioner is the commercial quantity.

Considering the facts and circumstances of the case and the quantity of ganja, this Court is not inclined to grant bail to the petitioner at this stage.
