THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.15078 of 2015 ORDER:
Petitioners allege that respondents 4 to 9 claiming the land to the extent of Ac. 5.43 cents in Survey No.570, situated at Kothapalli Village, Challagirigal Panchayat, Kanigiri Mandal, Prakasam District obtained a decree in O.S.No.33 of 2005. It appears that against the said decree passed by Junior Civil Judge, Kanigiri, dated 18.11.2009, in O.S.No.33 of 2005 in favour of respondents 4 to 9, petitioners preferred A.S.No.2 to 2010 before the Senior Civil Judge, Kandukur. While the said appeal is pending, alleging that respondents 2 and 3 are interfering, at the instance of respondents 4 to 9, petitioners filed this writ petition.
2. Instructions of the learned Government Pleader for Home show that respondents 2 and 3 are aware of the pendency of the appeal and, as such, they denied any interference or any attempt as alleged by the respondents. It is also stated that petitioners are unnecessarily involving the respondents in the land dispute.
3. In view of the specific instructions that there is no interference by respondents 2 and 3, nothing further survives in this writ petition for consideration.
4. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
