JUDGMENT
The learned counsel for the appellant states that the appeal filed under Section 372 Cr.P.C. by the appellant would not lie since amendment of Section 372 Cr.P.C. introducing the proviso thereto has been held to be prospective by this Court in the judgment by a Division Bench of this Court in Godugunuri Siva Reddy @ Venkata Siva Reddy Vs. The State of A.P.[1]. However, he seeks leave to avail appropriate remedy.
Granting leave to the appellant to seek appropriate remedy, this Criminal Appeal is dismissed as not maintainable. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
