This petition is filed to transfer O.P.No.151 of 2013 from the file of Family Court, Secunderabad to the Family Court, Mahabubnagar. The case of the petitioner is that the marriage of the petitioner was performed with the respondent on 23-02-1994 at Secunderabad according to Hindu rites. Due to their wedlock, they were blessed with three children. Thereafter, the respondent started harassing the petitioner, she filed maintenance case in M.C.No.28 of 2009 on the file of Family Court, Mahabubnagar and the same was allowed granting maintenance to the petitioner and her children. It is further stated that the respondent filed O.P.No.151 of 2013 on the file of Family Court, Secunderabad for grant of divorce against the petitioner.

Now, the present Transfer CMP is filed for transferring the same to Family Court, Mahabubnagar on the ground that the petitioner is residing with her children at Mahabubnagar and she has no avocation and no income and that she is unable to travel all the way from Mahabubnagar to Secunderabad to defend her case. Though notice is sent and the same is not claimed by the respondent. In view of the fact that notices are sent on the address given by respondent in the O.P. and since the same are unclaimed, it is deemed that notice is served on the respondent. Inspite of the same, there is no appearance for the respondent.

In view of above facts and circumstances stated by the petitioner, this Transfer CMP is allowed and O.P.No.151 of 2013 is withdrawn from the file of Family Court, Secunderabad and transferred to the Family Court, Mahabubnagar.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
