HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.1108 OF 2015 ORDER:

Heard the learned counsel for the petitioner and Sri R.N. Reddy, counsel for the respondents. The petitioner prays for Mandamus declaring inaction of respondents in settling the provident fund claim made by he petitioner upon the demise of petitioner's son (Member ID:

APKKP00518600000000277), as illegal and amounts to failure to exercise the jurisdiction conferred on the respondents.

The learned standing counsel, on instructions, submits that without reference to the grievance set out in the writ affidavit, he has instructions to submit that if the petitioner resubmits the claim for payment of provident fund, the same will be processed and provident fund is released within two weeks from the date of receipt of claim made by the petitioner. Having regard to the circumstances, in which the petitioner is placed, the learned standing counsel submits that Sri K.Shivaram, Assistant Commissioner, Pensions, is to be approached for presentation of claim and settlement.
