THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No.41353 of 2014 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for the respondents. Petitioners, in this writ petition, question the show cause notices issued to them alleging violation under Section 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977. Petitioners have questioned the issuance of the said notices on various grounds, including that there is violation of principles of natural justice. However, the jurisdiction of the authority is not questioned. Hence, there is no reason to entertain the writ petition on the show cause notices. Petitioners also placed reliance upon similar issue considered by this Court in W.P.No.4141 of 2012 dated 16.02.2012.
It is, however, stated on instructions by the learned Government Pleader that no orders have been passed in pursuance of the said notices.
In the circumstances, I deem it appropriate to dispose of the writ petition permitting the petitioners to file their objections, if any, to the said notices, if not filed earlier, within a period of three weeks from today and the respondents are directed to consider the said revision/objections and pass appropriate orders in accordance with law. Pending completion of the aforesaid exercise, no coercive action as to dispossession be taken against the petitioners and all such actions would abide the result of the final orders to be passed as directed above. There shall be no order as to costs. The miscellaneous petitions filed in this writ petition shall also stand disposed of.
