THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9566 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.2 in Crime.No.129 of 2023 on the file of Garla Police Station, Mahbubabad District, registered for the offences under Section 304-B of IPC and Sections 3 & 4 of the Dowry Prohibition Act, 1961.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

Petitioner is the father-n-law of the deceased. A-1, who is the son of the petitioner was married to the deceased six years prior to her death. At the time of marriage, dowry was also given. The allegation is that the husband started harassing the deceased for Rs.2,00,000/- additional dowry and was addicted to bad habits. On

11.09.2023, she committed suicide by jumping into the well.

Since there are no specific allegations leveled against this petitioner even according to the remand report and petitioner been father-in-law of the deceased, this Court is inclined to grant the relief of regular bail to the petitioner, subject to following conditions:

i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties, for a like sum each to the satisfaction of Principal Judicial First Class Magistrate, at Mahabubabad. ii) The petitioner/Accused No.2 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
