HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Transfer Civil Miscellaneous Petition No.192 of 2017 ORDER:
The wife in O.P.No.254 of 2017, pending on the file of Judge, Family Court, City Civil Court, Hyderabad, is the present petitioner. She made the request for withdrawal of the said O.P. pending on the file of Family Court, City Civil Court, Hyderabad, and to transfer the same to the file of Judge, Family Court, Nizamabad, under Section 24 of the Civil Procedure Code, 1908.

The husband, who is the respondent herein, filed O.P. No.254 of 2017 for annulment of marriage that took place on 1.5.2015.

Heard Sri M. Karuna Sagar, learned counsel for the petitioner.

Despite listing the matter to afford an opportunity to the respondent of being heard, there was no representation for the respondent-husband.

The ground on which the present request is made is that she is very poor and cannot meet the travel expenses and other expenses to attend the Court at Hyderabad by travelling from Nizamabad, that too being a woman without male assistance. The said ground is based on convenience of the petitioner herein. The very fact that she is dependent on her parents, without having any
independent income, would, thus, reflects that it would be difficult for her to meet the travel expenses and other incidental expenses to go over to Hyderabad from her place at Nizamabad and also the ground that she has no male assistance to accompany her to Hyderabad for every adjournment are sufficient to hold that it would be just and reasonable to accede to her request.

Hence, the Transfer Civil Miscellaneous Petition is allowed. Consequently, O.P. No.254 of 2017 pending on the file of Judge, Family Court, City Civil Court, Hyderabad, is withdrawn and transferred to the file of Judge, Family Court at Nizamabad, Nizamabad District. The transferee Court shall issue notices to both parties on receipt of case bundle and dispose of O.P. in accordance with law. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions if any pending in the Transfer Civil Miscellaneous Petition shall stand closed. ________________________ A.SHANKAR NARAYANA Dt. 30.04.2018 gbs
