HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.28266 of 2015 ORDER:
There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue a writ, order, direction more particularly a writ in the nature of writ of mandamus declaring the action of the respondent officials for not investigating into FIR No.245 of 2015 dated 20.04.2015 before the PS Chaitanyapuri and implicating the petitioner in false case in FIR No.394 of 2015 dated 28.06.2015 as illegal, arbitrary and violation of Article 14 and 21 of Constitution of India. Consequently directing the respondents to conduct and complete the investigation in FIR No.245 of 2015 dated 20.04.2015."
During the course of hearing, the learned Government Pleader appearing for the respondents submit that after investigation a final report was filed in Crime No.245 of 2015 referring it as a false case. As far as Crime No.394 of 2015 is concerned, after investigation, a charge sheet has been filed on the file of the XI Metropolitan Magistrate, Cyberabad. The learned Magistrate, after taking cognizance of the offence, numbered the case as C.C.No.877 of and the same is pending consideration.
In view of the above, this Court is of the opinion that no further orders are required in the writ petition. Accordingly, the writ petition is closed. No costs. Miscellaneous petitions, if any, shall also stand closed. _____________________ P. KESHAVA RAO, J Date: 22.11.2018.
