THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.33037 of 2015 ORDER:

Petitioners claim to be part owners of land in Survey No.419 situated at Pallabuzurg Village, Narayanpet Mandal, Mahabubnagar District, having purchased from its erstwhile occupier under a registered sale deed. One Balaiah Puttapalli was shown as possessor. However, it is accepted that in the khasra pahani, the land is shown as Government poramboke. It appears that in suo motu Land Grabbing Case in LGC(SR).No.3097 of 2012, reports were called for and the District Collector submitted a report stating that the lands in various survey numbers including Survey No.419 are assigned lands and appropriate steps are being taken. The petitioners complain that on the basis of said report, their long possession is being threatened and their names are being deleted from the occupier column.

They also state that they have not been served with any notice by the official respondents. The said Land Grabbing Case was also closed on 03.01.2014 on the basis of the report of the Collector. It is stated that proceedings are being taken to dispossess the petitioners. Heard learned Government Pleader for Revenue, who states that if any person other than the Government is in possession of the land, appropriate proceedings would be taken by following due process of law. Apparently, since no notice and opportunity are given to the petitioners, it is appropriate to direct respondents 3 and 4 that if any action is intended to be taken against the petitioners, the respondents shall follow due procedure under law and only thereafter take such appropriate steps in accordance with law as it deserves.

The Writ Petition is accordingly disposed of.

Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. No order as to costs.
