THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.8539 OF 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition is filed questioning the distraint notice dated 5.2.2015 issued by respondent No.3 - Municipality.

At this stage we are not inclined to interfere with the action taken by the respondent - Municipality as the petitioner has also filed a revision petition dt.12.3.2015 before the Commissioner of the Municipality.

We therefore dispose of the writ petition directing the Commissioner of the respondent Municipality to hear the petitioner and pass a speaking order on the revision petition filed by him, in accordance with law. The entire exercise shall be completed within a period of six weeks from the date of communication of this order. Till such decision is taken, no coercive steps shall be taken by the Municipality against the petitioner.

Pending miscellaneous petitions, if any, shall stand closed. There will be no order as to costs.
