THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.40526 of 2015 ORDER:
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit the petitioner prays that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of respondents 1 to 3 in not executing Non Bailable warrant pending against 4th respondent, though issued on 25.04.2013 in E.A.No.8 of 2012 in C.C.No.26 of2011 on the file of District Forum at Kadapa, in execution of it's order dt. 13.06.2011, as illegal, irregular, irrational and amounts to non discharge of legal obligation conferred on 3rd respondent and violative of provisions of the Consumer Protection Act, 1986 and rules framed thereunder and offends article 14 of Constitution of India and consequently direct the respondents 1 to 3 to execute the said Non Bailable Warrant and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
Written instructions dated 25.01.2016 were furnished by the Sub Inspector of Police, Rajampet Town Police Station, Kadapa District, stating that the non-bailable warrant pending against the 4th respondent issued in E.A.No.8 of 2012 in C.C.No.26 of 2011 on the file of District Forum at Kadapa, was executed on the Ex-President of Rajampet Co-operative Building Society Limited, Kasireddy Sambasiva Reddy, on 22.01.2016. He was released on bail with a further direction that he should attend the hearing. In the light of the aforestated development, the grievance of the petitioner stands settled.
The writ petition is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
