HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.2 3 3 3 1 of 2 0 1 8 ORDER: - memo, bearing No.AP16TH4956/ A3/ 2017, dated 25.06.2018, issued by the Deputy Transport Commissioner/ R.3 is under challenge in the present Writ Petition. In fact, in response to the said memo, dated 25.06.2018, the petitioner herein submitted an explanation on 28.06.2018. During the course of arguments, it is submitted by Sri K.Satyanarayana Murthy, learned Counsel appearing for the petitioner, that the figures mentioned in the impugned memo are contrary to the provisions of Section 192-A of the Motor Vehicles Act, 1988 and also contrary to the amendments carried out to the A.P.Motor Vehicles Rules, 1989, notified vide G.O.Ms.No.332, Transport, Roads & Buildings (TR.I) Department, dated 13.11.2008.

As the petitioner already submitted an explanation in response to the impugned memo, it is open for the petitioner herein to bring to the notice of the 3rd respondent herein the above provisions of law at the time of considering the explanation, dated 28.06.2018. For the aforesaid reasons, the Writ Petition is disposed of, directing the 3rd respondent herein to consider the explanation, dated 28.06.2018, submitted by the petitioner herein in response to the impugned memo, dated 25.06.2018, and pass appropriate orders, strictly in accordance with law, preferably within a period of two months from the date of receipt of a copy of this order.
